Terms of Service
Effective date: 1 June 2026
Welcome to Larkling. By accessing or using Larkling — the co-parenting platform available at larklingapp.com and app.larklingapp.com (the “Service”) — you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
These Terms form a legally binding agreement between you (“you” or “User”) and Larkling (“Larkling,” “we,” “us,” or “our”). If you do not agree to these Terms, you must not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. These documents together form the entire agreement between you and Larkling.
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 18 years of age to create an account and use the Service. By using Larkling, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
The Service is primarily intended for users in the United Kingdom. If you access the Service from outside the UK, you do so at your own initiative and are responsible for compliance with local laws where applicable.
3. Account Responsibilities
You are responsible for:
- Providing accurate, complete, and up-to-date information when creating your account;
- Maintaining the confidentiality of your login credentials and for all activity that occurs under your account;
- Notifying us immediately at hello@larklingapp.com if you suspect any unauthorised use of your account;
- Ensuring that any co-parent, family member, or other individual you add to your family circle has consented to use the Service and agrees to these Terms.
You may not share your account credentials with anyone else. Larkling is not liable for any loss or damage arising from your failure to safeguard your account.
4. Free Forever Core Plan
Larkling’s core features are free forever, with no credit card required. These core features include, but are not limited to:
- Shared calendar and custody scheduling;
- Secure, unalterable messaging;
- Expense tracking and splitting;
- Private journal with timestamps;
- Document vault (up to a generous free limit);
- Inclusive family setup (LGBTQ+, blended, single-parent, polyamorous, and donor-conceived families).
We reserve the right to adjust the scope of core features over time, but we are committed to keeping the essential co-parenting toolkit free. If we ever introduce charges for features that are currently free, we will give you at least 30 days’ notice and an opportunity to export your data.
5. Premium Plan
Larkling offers an optional Premium plan at £6.99 per month per family (inclusive of VAT where applicable). A “family” means all users connected within a single family circle on the Service. Premium features include:
- Unlimited AI Tone Coach rewrites;
- Tamper-evident PDF exports suitable for court proceedings;
- Full, searchable message history;
- Unlimited document storage;
- Priority support.
Premium subscriptions renew automatically each month unless cancelled. You may cancel at any time; cancellation takes effect at the end of your current billing period and you will retain access to Premium features until that date. Refunds are provided on a pro-rata basis if you cancel within 14 days of purchase (the cooling-off period under UK consumer law) — simply email hello@larklingapp.com. No refunds are provided for partial months after the cooling-off period.
We may change the Premium price with 30 days’ notice. If the price increases, you may cancel before the new price takes effect.
6. Acceptable Use
You agree not to use the Service to:
- Harass, abuse, threaten, or intimidate any other user;
- Upload, share, or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Use the Service for any illegal purpose or in violation of any applicable law or regulation;
- Attempt to interfere with, compromise, or disrupt the Service, its servers, or its security;
- Reverse-engineer, decompile, or extract the source code of the Service;
- Use automated means (bots, scrapers, spiders) to access or collect data from the Service without our express written permission;
- Upload viruses, malware, or any malicious code;
- Use the Service to create false or misleading records intended to deceive a court, mediator, or other authority;
- Share any content that infringes the intellectual property rights of others.
We reserve the right, at our sole discretion, to suspend or terminate your account if we determine that you have violated these acceptable use terms. We will, where practical, provide notice and an opportunity to remedy minor violations before taking action.
7. Intellectual Property
The Larkling name, logo, branding, and all content on the Service — including text, graphics, icons, design, software, and the overall look-and-feel — are the exclusive intellectual property of Larkling and are protected by UK and international copyright, trademark, and intellectual property laws.
You may not copy, reproduce, republish, or redistribute any part of the Service or its branding without our prior written consent.
Your content remains yours. By uploading or sharing content (messages, calendar entries, expense records, journal entries, documents, etc.) on the Service, you grant Larkling a limited, non-exclusive licence to host, store, and display that content solely for the purpose of providing the Service to you and the other members of your family circle. We do not claim ownership of your data.
8. Disclaimer
Larkling is not legal advice. The Service is a communication and organisation tool. Nothing on Larkling — including AI Tone Coach suggestions, court-ready exports, guides, blog posts, or any other content — constitutes legal advice. If you need legal advice, you must consult a qualified solicitor or legal professional. We do not warrant that records exported from Larkling will be accepted by any particular court, mediator, or authority.
Larkling is not therapy. The Service is not a substitute for professional mental health support, counselling, or mediation. The AI Tone Coach is a stylistic aid only — it does not provide psychological, therapeutic, or medical advice. If you are in crisis, please contact the Samaritans on 116 123 (UK) or your local emergency services.
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Larkling shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of (or inability to use) the Service.
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any other liability that cannot be excluded or limited under applicable law (including, in the UK, your statutory rights under the Consumer Rights Act 2015).
Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you have paid to Larkling in the 12 months preceding the claim, or (b) £100.
10. Termination
You may stop using the Service at any time. You can delete your account through the app settings or by contacting us at hello@larklingapp.com. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy.
We may suspend or terminate your access to the Service at any time, without prior notice, if:
- You breach these Terms;
- Your conduct risks harm to other users, to Larkling, or to third parties;
- We are required to do so by law or a regulatory authority;
- We decide in good faith to discontinue the Service (in which case we will give you reasonable notice and an opportunity to export your data).
Provisions that by their nature should survive termination — including but not limited to Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law — shall continue to apply after termination.
11. Governing Law
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales.
Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any legal proceedings arising from these Terms.
